Deze privacyverklaring is opgesteld in het Nederlands. Bij verschil tussen de Nederlandse en Engelse versie op deze pagina is de Nederlandse versie leidend.

Privacyverklaring — Hai Five Studio

Hai Ecommerce, handelend onder de naam Hai Five Studio ("wij", "ons"), is verantwoordelijk voor de verwerking van persoonsgegevens zoals beschreven in deze privacyverklaring. Wij zijn de verwerkingsverantwoordelijke in de zin van de Algemene Verordening Gegevensbescherming (AVG).

Wij hebben geen functionaris gegevensbescherming aangesteld: gezien de aard en omvang van onze webshop (verkoop van kleding, geen grootschalige of systematische monitoring en geen verwerking van bijzondere persoonsgegevens) zijn wij daartoe niet wettelijk verplicht. Vragen over privacy kunt u via bovenstaande contactgegevens aan ons stellen.

2. Welke persoonsgegevens verwerken wij

  • Contactgegevens: naam, factuuradres, verzendadres, telefoonnummer, e-mailadres.
  • Bestel- en betaalgegevens: bestelde producten, ordergeschiedenis, betaalmethode en transactiegegevens (betalingen zelf worden verwerkt door Mollie B.V., zie hieronder).
  • Accountgegevens: indien u een account aanmaakt, uw gebruikersnaam en voorkeuren.
  • Communicatie: berichten die u ons stuurt via het contactformulier, e-mail of WhatsApp.
  • Technische gegevens: IP-adres, browsertype en apparaatgegevens, uitsluitend voor zover noodzakelijk voor het functioneren van de webshop (zie het cookie-overzicht in hoofdstuk 7).

3. Waarvoor en op welke grondslag gebruiken wij uw gegevens

  • Uitvoering van de overeenkomst: het verwerken en bezorgen van uw bestelling, klantenservice, retouren en garantie (grondslag: uitvoering overeenkomst, art. 6(1)(b) AVG).
  • Wettelijke verplichtingen: onder andere onze fiscale administratieplicht (grondslag: wettelijke verplichting, art. 6(1)(c) AVG).
  • Klantcommunicatie en fraudepreventie: het beveiligen van onze webshop en het beantwoorden van vragen (grondslag: gerechtvaardigd belang, art. 6(1)(f) AVG).
  • Nieuwsbrief/marketing: alleen indien u zich hiervoor actief heeft aangemeld (grondslag: toestemming, art. 6(1)(a) AVG); u kunt zich op elk moment afmelden via de link in elke e-mail.

4. Met wie delen wij uw gegevens

Wij delen persoonsgegevens uitsluitend met partijen die deze nodig hebben om onze dienstverlening mogelijk te maken:

  • Shopify — ons webshopplatform en hostingpartij, verwerkt gegevens namens ons om de webshop te laten functioneren.
  • Mollie B.V. — onze betaaldienstverlener, verwerkt uw betaalgegevens om transacties af te ronden.
  • Bezorgdiensten — om uw bestelling af te leveren, delen wij uw naam en verzendadres met de vervoerder die uw pakket bezorgt.
  • Overheidsinstanties, uitsluitend indien wij daartoe wettelijk verplicht zijn.

Wij maken op dit moment geen gebruik van analytische, advertentie- of trackingtools (zoals Google Analytics of advertentiepixels). Zodra dit verandert, werken wij deze privacyverklaring en ons cookiebeleid bij vóórdat de betreffende tools worden geactiveerd, en vragen wij waar wettelijk vereist eerst uw toestemming.

5. Doorgifte van gegevens buiten de EER

Shopify en Mollie kunnen gegevens verwerken op servers buiten de Europese Economische Ruimte (EER), waaronder in de Verenigde Staten. Voor dergelijke doorgiftes wordt gebruikgemaakt van passende waarborgen, zoals de Standard Contractual Clauses van de Europese Commissie en/of — voor zover van toepassing en geldig — het EU-VS Data Privacy Framework. U kunt bij ons een kopie van de toepasselijke waarborgen opvragen.

6. Bewaartermijnen

Wij bewaren persoonsgegevens niet langer dan noodzakelijk is voor de doeleinden waarvoor zij zijn verzameld. Gegevens die deel uitmaken van onze financiële administratie (zoals facturen) bewaren wij gedurende de wettelijke fiscale bewaarplicht van 7 jaar. Accountgegevens bewaren wij zolang uw account actief is; op verzoek verwijderen wij deze eerder, voor zover geen wettelijke bewaarplicht zich daartegen verzet.

7. Cookies

Onze webshop gebruikt op dit moment uitsluitend functionele/noodzakelijke cookies — bijvoorbeeld voor het onthouden van de inhoud van uw winkelwagen, het afronden van een bestelling, en beveiliging. Voor dit type cookies is, conform artikel 11.7a lid 3 Telecommunicatiewet, geen voorafgaande toestemming vereist.

Wij plaatsen op dit moment geen analytische, marketing- of trackingcookies. Mochten wij dit in de toekomst wel gaan doen (bijvoorbeeld voor websitestatistieken of gepersonaliseerde advertenties), dan vragen wij daarvoor vooraf uw uitdrukkelijke toestemming via een duidelijke cookiebanner, conform de eisen van de Autoriteit Persoonsgegevens: geen vooraf aangevinkte vakjes, gelijkwaardige "accepteren"- en "weigeren"-knoppen, en een eenvoudige manier om uw toestemming later weer in te trekken. Deze privacyverklaring wordt dan bijgewerkt met een volledig overzicht van de gebruikte cookies.

8. Uw rechten

U heeft op grond van de AVG de volgende rechten met betrekking tot uw persoonsgegevens:

  • Recht op inzage in de gegevens die wij van u verwerken.
  • Recht op rectificatie van onjuiste of onvolledige gegevens.
  • Recht op verwijdering ("recht op vergetelheid").
  • Recht op beperking van de verwerking.
  • Recht op bezwaar tegen de verwerking.
  • Recht op overdraagbaarheid van gegevens ("dataportabiliteit").
  • Recht om uw toestemming te allen tijde in te trekken, voor zover de verwerking op toestemming is gebaseerd.

U kunt deze rechten uitoefenen door contact met ons op te nemen via support@hai-ict.nl. Wij reageren binnen de wettelijke termijn. Bent u niet tevreden met onze reactie? Dan heeft u het recht om een klacht in te dienen bij de Autoriteit Persoonsgegevens (autoriteitpersoonsgegevens.nl).

9. Beveiliging

Wij nemen passende technische en organisatorische maatregelen om uw persoonsgegevens te beschermen tegen verlies of onrechtmatige verwerking. Geen enkele beveiligingsmaatregel is echter volledig sluitend; wij raden aan geen gevoelige informatie via onbeveiligde kanalen aan ons te versturen.

10. Wijzigingen

Wij kunnen deze privacyverklaring van tijd tot tijd aanpassen, bijvoorbeeld bij wijzigingen in onze dienstverlening of de wetgeving. De meest actuele versie is altijd op deze pagina te vinden.

Hai Ecommerce, trading as Hai Five Studio ("we", "us"), is responsible for the processing of personal data as described in this privacy policy. We are the data controller within the meaning of the General Data Protection Regulation (GDPR).

We have not appointed a Data Protection Officer: given the nature and scale of our webshop (selling clothing, no large-scale or systematic monitoring, and no processing of special-category data), we are not legally required to do so. Privacy questions can be directed to the contact details above.

2. What personal data we process

  • Contact details: name, billing address, shipping address, phone number, email address.
  • Order and payment data: products ordered, order history, payment method and transaction details (payments themselves are processed by Mollie B.V., see below).
  • Account data: if you create an account, your username and preferences.
  • Communications: messages you send us via the contact form, email, or WhatsApp.
  • Technical data: IP address, browser type, and device information, only to the extent necessary for the webshop to function (see the cookie overview in section 7).

3. Why and on what legal basis we use your data

  • Performance of the contract: processing and delivering your order, customer service, returns, and warranty claims (basis: performance of a contract, Art. 6(1)(b) GDPR).
  • Legal obligations: including our statutory bookkeeping obligations (basis: legal obligation, Art. 6(1)(c) GDPR).
  • Customer communication and fraud prevention: securing our webshop and answering questions (basis: legitimate interest, Art. 6(1)(f) GDPR).
  • Newsletter/marketing: only if you have actively signed up (basis: consent, Art. 6(1)(a) GDPR); you can unsubscribe at any time via the link in every email.

4. Who we share your data with

We only share personal data with parties that need it to provide our service:

  • Shopify — our webshop platform and hosting provider, processes data on our behalf to run the webshop.
  • Mollie B.V. — our payment service provider, processes your payment details to complete transactions.
  • Shipping carriers — to deliver your order, we share your name and shipping address with the carrier delivering your package.
  • Government authorities, only where legally required.

We do not currently use any analytics, advertising, or tracking tools (such as Google Analytics or ad pixels). If this changes, we will update this privacy policy and our cookie section before activating any such tools, and will ask for your consent first wherever legally required.

5. International data transfers

Shopify and Mollie may process data on servers outside the European Economic Area (EEA), including in the United States. Such transfers rely on appropriate safeguards, such as the European Commission's Standard Contractual Clauses and/or — where applicable and valid — the EU-US Data Privacy Framework. You may request a copy of the applicable safeguards from us.

6. Retention periods

We do not retain personal data longer than necessary for the purposes for which it was collected. Data forming part of our financial records (such as invoices) is retained for the statutory Dutch tax-record retention period of 7 years. Account data is retained for as long as your account is active; on request we delete it sooner, unless a legal retention obligation prevents this.

7. Cookies

Our webshop currently uses only functional/necessary cookies — for example to remember your shopping cart contents, complete an order, and for security. Under Article 11.7a(3) of the Dutch Telecommunications Act, no prior consent is required for this type of cookie.

We currently place no analytics, marketing, or tracking cookies. Should we do so in the future (for example for website statistics or personalized advertising), we will first ask for your explicit consent via a clear cookie banner, in line with the Dutch Data Protection Authority's requirements: no pre-ticked boxes, equally prominent "accept" and "reject" buttons, and an easy way to withdraw your consent later. This privacy policy will then be updated with a full overview of the cookies used.

8. Your rights

Under the GDPR you have the following rights regarding your personal data:

  • The right to access the data we process about you.
  • The right to rectification of inaccurate or incomplete data.
  • The right to erasure ("right to be forgotten").
  • The right to restriction of processing.
  • The right to object to processing.
  • The right to data portability.
  • The right to withdraw your consent at any time, where processing is based on consent.

You can exercise these rights by contacting us at support@hai-ict.nl. We will respond within the statutory timeframe. If you are not satisfied with our response, you have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens, autoriteitpersoonsgegevens.nl), or with the data protection authority in your own EU country.

9. Security

We take appropriate technical and organizational measures to protect your personal data against loss or unlawful processing. However, no security measure is completely foolproof; we recommend not sending sensitive information to us via unsecured channels.

10. Changes

We may update this privacy policy from time to time, for example following changes to our services or the law. The most current version can always be found on this page.
