Deze algemene voorwaarden zijn opgesteld in het Nederlands. Bij verschil tussen de Nederlandse en Engelse versie op deze pagina is de Nederlandse versie leidend.

Artikel 2 — Definities
- Ondernemer: Hai Ecommerce, handelend onder de naam Hai Five Studio, zoals hierboven vermeld.
- Consument: de natuurlijke persoon die niet handelt in de uitoefening van een beroep of bedrijf en een overeenkomst op afstand aangaat met de ondernemer.
- Overeenkomst op afstand: een overeenkomst die tot stand komt via de webshop van de ondernemer, waarbij uitsluitend gebruik wordt gemaakt van één of meer technieken voor communicatie op afstand.
- Bedenktijd: de termijn waarbinnen de consument gebruik kan maken van zijn herroepingsrecht.
- Herroepingsrecht: de mogelijkheid voor de consument om binnen de bedenktijd af te zien van de overeenkomst op afstand.
- Duurzame gegevensdrager: elk hulpmiddel dat de consument in staat stelt om informatie die aan hem persoonlijk is gericht op te slaan op een manier die toekomstige raadpleging mogelijk maakt (bijvoorbeeld e-mail).
Artikel 3 — Toepasselijkheid
Deze algemene voorwaarden zijn van toepassing op elk aanbod van de ondernemer en op elke tot stand gekomen overeenkomst op afstand tussen de ondernemer en de consument via de webshop van Hai Five Studio. Voordat de overeenkomst op afstand wordt gesloten, wordt de tekst van deze algemene voorwaarden aan de consument beschikbaar gesteld.
Artikel 4 — Het aanbod
Het aanbod bevat een volledige en nauwkeurige omschrijving van de aangeboden producten, inclusief afbeeldingen. Kennelijke vergissingen of fouten in het aanbod binden de ondernemer niet. Elk aanbod bevat zodanige informatie dat voor de consument duidelijk is wat de rechten en verplichtingen zijn die aan de aanvaarding van het aanbod zijn verbonden.
Artikel 5 — De overeenkomst
De overeenkomst komt tot stand op het moment van aanvaarding door de consument van het aanbod en het voldoen aan de daarbij gestelde voorwaarden. De ondernemer bevestigt onverwijld langs elektronische weg de ontvangst van de aanvaarding van het aanbod. Zolang de ontvangst van deze aanvaarding niet is bevestigd, kan de consument de overeenkomst ontbinden.
Bij het sluiten van de overeenkomst verstrekt de ondernemer de consument, zoals wettelijk vereist, informatie over onder meer: de identiteit en het adres van de ondernemer, de belangrijkste kenmerken van het product, de totale prijs inclusief belastingen, de kosten van levering, de wijze van betaling, aflevering of uitvoering, de termijn voor aanvaarding van het aanbod, het al dan niet van toepassing zijn van het herroepingsrecht en de voorwaarden, termijn en wijze van uitoefening daarvan, en de wijze waarop de consument klachten kan indienen.
Artikel 6 — Herroepingsrecht
Bij de aankoop van producten heeft de consument de mogelijkheid de overeenkomst zonder opgave van redenen te ontbinden gedurende 14 dagen. Deze bedenktijd gaat in op de dag na ontvangst van het product door de consument, of een vooraf door de consument aangewezen derde. Bij een bestelling die uit meerdere zendingen of onderdelen bestaat, gaat de bedenktijd in op de dag waarop de consument (of een door hem aangewezen derde) het laatste product of onderdeel heeft ontvangen.
Tijdens de bedenktijd zal de consument zorgvuldig omgaan met het product en de verpakking. De consument zal het product slechts uitpakken of gebruiken voor zover dat nodig is om de aard, de kenmerken en de werking van het product vast te stellen — vergelijkbaar met het passen van kleding in een fysieke winkel.
Om het herroepingsrecht uit te oefenen, kan de consument gebruikmaken van de online annuleringsfunctie op onze webshop (bereikbaar via de bestelstatuspagina of het bevestigingsmailtje van de bestelling), of een ondubbelzinnige verklaring afleggen (bijvoorbeeld via e-mail) waaruit blijkt dat hij de overeenkomst herroept. De ondernemer bevestigt de ontvangst van een dergelijke melding onverwijld op een duurzame gegevensdrager (bijvoorbeeld per e-mail). Een modelformulier voor herroeping is als bijlage bij deze voorwaarden opgenomen en ook te vinden in ons retourbeleid.
Artikel 7 — Kosten in geval van herroeping
Indien de consument gebruikmaakt van zijn herroepingsrecht, komen de kosten van het terugzenden van het product voor rekening van de consument. De consument dient het product zo snel mogelijk, doch binnen 14 dagen na de melding van herroeping, terug te sturen. Zodra de ondernemer het teruggezonden product heeft ontvangen (of het bewijs van terugzending), wordt het volledige aankoopbedrag, inclusief eventuele standaard verzendkosten van de oorspronkelijke bestelling, binnen 14 dagen terugbetaald via hetzelfde betaalmiddel waarmee is betaald, tenzij de consument instemt met een andere methode.
Artikel 8 — Uitsluiting herroepingsrecht
Op dit moment biedt Hai Five Studio geen gepersonaliseerde of op maat gemaakte producten aan; het herroepingsrecht is dus onverkort van toepassing op alle producten in onze webshop. Mocht dit aanbod in de toekomst wijzigen, dan wordt dit artikel aangepast conform de wettelijke uitzonderingen (waaronder volgens specificaties van de consument vervaardigde of duidelijk persoonlijke producten, artikel 6:230p sub c BW).
Artikel 9 — De prijs
Alle vermelde prijzen zijn in euro's en inclusief btw. Kennelijke fouten in de prijsopgave, zoals evidente onjuistheden, kunnen ook na de totstandkoming van de overeenkomst door de ondernemer worden gecorrigeerd.
Artikel 10 — Conformiteit en garantie
De ondernemer staat ervoor in dat de producten voldoen aan de overeenkomst, de in het aanbod vermelde specificaties, aan de redelijke eisen van deugdelijkheid en/of bruikbaarheid en aan de op de datum van de totstandkoming van de overeenkomst bestaande wettelijke bepalingen (artikel 7:17 en verder van het Burgerlijk Wetboek). Indien een product niet aan de overeenkomst beantwoordt, heeft de consument recht op kosteloos herstel, vervanging, passende prijsvermindering of ontbinding van de overeenkomst, in de wettelijk voorgeschreven volgorde en onder de wettelijk gestelde voorwaarden. Deze bepalingen doen niets af aan de wettelijke rechten die de consument op grond van dwingend recht toekomen.
Artikel 11 — Levering en uitvoering
Wij verzenden binnen Nederland en de rest van de Europese Unie. Zie ons verzendbeleid voor levertijden, verzendkosten en het moment waarop het risico van beschadiging en/of vermissing van producten op de consument overgaat (dit risico blijft, conform artikel 7:11/7:19 BW, bij de ondernemer totdat de consument de zaken feitelijk heeft ontvangen).
Artikel 12 — Betaling
Betalingen worden verwerkt via Mollie B.V., een payment service provider. De beschikbare betaalmethoden worden getoond tijdens het afrekenproces.
Artikel 13 — Klachtenregeling
Heeft u een klacht over een product, over deze algemene voorwaarden of over onze dienstverlening in het algemeen? Neem dan eerst rechtstreeks contact met ons op via support@hai-ict.nl of WhatsApp (+31 6 41057196), zodat we samen naar een oplossing kunnen zoeken. Wij streven ernaar klachten binnen 14 dagen inhoudelijk te beantwoorden.
Artikel 14 — Geschillen
Op overeenkomsten tussen de ondernemer en de consument is uitsluitend Nederlands recht van toepassing, ook indien de consument woonachtig is buiten Nederland — met dien verstande dat waar dwingend consumentenrecht van het land van de consument bescherming biedt die niet door een rechtskeuze kan worden uitgesloten, die bescherming onverkort geldt.
Sinds 20 juli 2025 is het Europese ODR-platform (Online Dispute Resolution) buiten gebruik gesteld. Voor de buitengerechtelijke beslechting van geschillen kunt u zich wenden tot een erkende geschillencommissie in uw land via de Europese verwijsgids voor ADR-instanties. Hai Five Studio is momenteel niet aangesloten bij een specifieke geschillencommissie.
Artikel 15 — Overige bepalingen
Indien een bepaling uit deze algemene voorwaarden nietig blijkt te zijn, blijven de overige bepalingen onverminderd van kracht. De ondernemer kan deze algemene voorwaarden wijzigen; de versie die gold op het moment van het sluiten van de overeenkomst blijft op die overeenkomst van toepassing.

Article 2 — Definitions
- Trader: Hai Ecommerce, trading as Hai Five Studio, as stated above.
- Consumer: a natural person not acting for purposes related to their trade, business, craft, or profession who enters into a distance contract with the trader.
- Distance contract: a contract concluded via the trader's webshop, using exclusively one or more means of distance communication.
- Cooling-off period: the period during which the consumer may use their right of withdrawal.
- Right of withdrawal: the consumer's option to cancel the distance contract within the cooling-off period.
- Durable medium: any tool enabling the consumer to store information addressed to them personally in a way that allows future access (e.g. email).
Article 3 — Applicability
These terms apply to every offer made by the trader and to every distance contract concluded between the trader and the consumer via the Hai Five Studio webshop. The text of these terms is made available to the consumer before the distance contract is concluded.
Article 4 — The offer
The offer contains a complete and accurate description of the products offered, including images. Obvious mistakes or errors in the offer do not bind the trader. Every offer contains sufficient information to make clear to the consumer what rights and obligations follow from accepting the offer.
Article 5 — The contract
The contract is concluded at the moment the consumer accepts the offer and meets the corresponding conditions. The trader confirms receipt of the acceptance of the offer electronically without delay. Until this confirmation has been received, the consumer may dissolve the contract.
When concluding the contract, the trader provides the consumer, as legally required, with information including: the identity and address of the trader, the main characteristics of the product, the total price including taxes, delivery costs, the method of payment, delivery or performance, the period for acceptance of the offer, whether the right of withdrawal applies and the conditions, term, and manner of exercising it, and how the consumer can submit complaints.
Article 6 — Right of withdrawal
When purchasing products, the consumer has the option to dissolve the contract without giving reasons for 14 days. This cooling-off period starts the day after the consumer, or a third party designated in advance by the consumer, receives the product. For an order consisting of multiple shipments or parts, the period starts on the day the consumer (or a designated third party) receives the last product or part.
During the cooling-off period, the consumer will handle the product and packaging with care. The consumer will only unpack or use the product to the extent necessary to establish its nature, characteristics, and functioning — comparable to trying on clothing in a physical store.
To exercise the right of withdrawal, the consumer can use the online cancellation function on our webshop (accessible from the order status page or order confirmation email), or make an unambiguous statement (for example by email) that they are withdrawing from the contract. The trader confirms receipt of such a notice without delay on a durable medium (e.g. by email). A model withdrawal form is included as an appendix to these terms and is also available in our refund policy.
Article 7 — Costs in case of withdrawal
If the consumer exercises their right of withdrawal, the cost of returning the product is borne by the consumer. The consumer must return the product as soon as possible, and within 14 days of notifying the withdrawal. Once the trader has received the returned product (or proof of return), the full purchase amount, including any standard shipping costs of the original order, is refunded within 14 days using the same payment method used for the original transaction, unless the consumer agrees to a different method.
Article 8 — Exclusion of the right of withdrawal
Hai Five Studio does not currently offer personalized or made-to-order products; the right of withdrawal therefore applies in full to every product in our webshop. Should this change in the future, this article will be updated to reflect the statutory exceptions (including goods made to the consumer's specifications or clearly personalized, Art. 6:230p(c) of the Dutch Civil Code).
Article 9 — Price
All listed prices are in euros and include VAT. Obvious errors in a price, such as evident inaccuracies, may be corrected by the trader even after the contract has been concluded.
Article 10 — Conformity and warranty
The trader guarantees that the products conform to the contract, the specifications stated in the offer, reasonable requirements of soundness and/or usability, and the statutory provisions in force on the date the contract was concluded (Article 7:17 et seq. of the Dutch Civil Code). If a product does not conform to the contract, the consumer is entitled to free repair, replacement, an appropriate price reduction, or dissolution of the contract, in the legally prescribed order and under the legally prescribed conditions. Nothing in these terms limits the statutory rights the consumer holds under mandatory law.
Article 11 — Delivery and performance
We ship within the Netherlands and the rest of the European Union. See our shipping policy for delivery times, shipping costs, and the point at which the risk of damage and/or loss of products passes to the consumer (this risk remains with the trader, per Articles 7:11/7:19 of the Dutch Civil Code, until the consumer actually receives the goods).
Article 12 — Payment
Payments are processed via Mollie B.V., a payment service provider. Available payment methods are shown during checkout.
Article 13 — Complaints procedure
Do you have a complaint about a product, these terms, or our service in general? Please contact us directly first via support@hai-ict.nl or WhatsApp (+31 6 41057196), so we can look for a solution together. We aim to respond to complaints substantively within 14 days.
Article 14 — Disputes
Dutch law exclusively applies to agreements between the trader and the consumer, even if the consumer resides outside the Netherlands — provided that where mandatory consumer-protection law of the consumer's own country grants protection that cannot be excluded by a choice of law, that protection continues to apply in full.
As of 20 July 2025, the European ODR (Online Dispute Resolution) platform has been discontinued. For out-of-court dispute resolution, you may contact a recognized dispute-resolution body in your country via the EU's directory of ADR bodies. Hai Five Studio is not currently affiliated with a specific dispute-resolution body.
Article 15 — Other provisions
If any provision of these terms is found to be void, the remaining provisions remain in full force. The trader may amend these terms; the version in force at the time the contract was concluded remains applicable to that contract.
